SPC legal successfully represented UAB “T parkas” (owner of a former “Taxi park”) in a dispute regarding termination of state-owned land lease agreement

SPC legal Real Estate & Construction Team successfully represented the client UAB “T parkas” in a dispute regarding termination of state-owned land lease agreement with other user of the land plot.

When the client acquired 30,000 sq.m. area property, also known as “Taxi park”, in 2016 which is located nearby Vilnius Central Rail Station, he has encountered number of operational issues pertaining to ability to use the land necessary for the building. Although there are many other buildings on the land, for some strange reason, the asphalt layer, which was put many years ago on land plot among the buildings and served as lot/area for access to them, was formed and registered as individual real estate object owned by one person. Also, owner of this asphalt layer was granted a lease to major part of the land plot, which was covered by the asphalt.

This situation was misused and various operational obstacles occurred as owners of the buildings, located on the land plot, were precluded from properly using them and the land.

Based on our client’s initiative, state-owned land lease agreement with the asphalt owner was terminated, however, decision of the National Land Service to that effect was brought to the court.

In course of a court dispute SPC legal brought counter-claims whereby requested for nullification of former decisions of the National Land Service whereby asphalt owner was granted a land lease rights and establishment of an easement in respect of the asphalt (a lot).

The higher court, after consideration of all claims of appeal, accepted our client’s arguments as well-grounded: has declared former decision of the National Land Service as null and void, and also instructed the lower court to re-consider our request regarding establishment of the easement as there are solid factual and legal grounds for it.
